The firm has experience and expertise in providing employment and labour related advice. The firm also represents clients at forums such as the CCMA, Bargaining Councils and the Labour Court. Furthermore, the firm assists in respect of disciplinary processes, reviewing or drafting HR policies and employment contracts.
Occupational Health & Safety
Similar to aspects relating to mine health and safety under the MHSA, the Firm has experience and expertise in relation to general health and safety aspects under the OHSA, which includes assisting construction companies with the management of fatal accidents at sites, and subsequent interaction with the Department of Labour.
Litigation
The foremost consideration in relation to litigious matters is to manage costs for clients. The Firm has experience and expertise in respect of various aspects of commercial and general litigation, from action proceedings to application proceedings, including arbitrations. The Firm is well versed with the process and procedures of both the Magistrates’ Court and the High Court. The Firm has effectively developed a litigation strategy and methodology which is geared towards speedy resolution of disputes, management of costs and keeping clients constantly informed of developments. This also includes debt collection.
Mining
The Firm has experience and expertise pertaining to legal aspects relating to the mining industry and the related legislation such as the MPRDA. This includes, but not limited to, providing advice and attending to litigation matters involving prospecting and mining rights disputes, reviewing of undesirable decisions taken by the Department of Mineral Resources, preparing and drafting various industry related agreements and documents, and providing assistance and advice regarding regulatory aspects.
Environmental
In light of the industries that the Firm provides services to, the Firm has experience and expertise on aspects relating to environmental law as governed by the NEMA and related Act, which includes but not limited to issues relating to consultations, EIAs and Water Use Licences and assistance with institutions such as the Water Tribunal.
Mine Health and Safety
The Firm has experience and expertise in providing legal assistance and support insofar as mine health and safety issues are concerned as regulated by the MHSA. This includes assistance with audits and compliance with the provisions of the MHSA, and the processes stipulated therein, such as investigations or inquiries conducted by the Department of Mineral Resources – Mine Health and Safety Inspectorate.
Corporate & Commercial
The Firm has experience and expertise in respect of aspects ranging from the sale and acquisition of shares, to providing advice relating to board composition and other aspects of the Companies Act and the Close Corporations Act. Experience and expertise also relate to the drafting of various commercial agreements, which include, but not limited to, lease agreements, purchase and sale agreements, loan agreements, mining industry related agreements, shareholders’ agreements, nondisclosure agreements, agency agreements, sponsorship agreements, cessions agreements, bursary agreements, services level agreements, surety agreements, consultancy services agreements, ICT industry related agreements and employment related agreements. Experience and expertise with regard to Corporate and Commercial also relate to aspects pertaining to corporate governance.
Conveyancing
The Firm, through its own in-house Notary, Conveyancer and Property Law Specialist, has in depth knowledge in the property market and related fields. In this regard, the Firm experience and expertise in relation to transfers of immovable property, registrations of mortgage bonds and complex development related transactions (such as opening Sectional Title Schemes, Township Developments, Sub-divisions and Consolidation of properties).
